WELLSTATE is a wellness-focused property certification company offering proprietary assessments, reports, and digital certification services. Our tools are designed to help individuals, developers, and property professionals evaluate how their living spaces support wellness, health, and environmental harmony.
2. Use of This Website
By using www.wellstate.com.au or purchasing any WELLSTATE services, you agree to use the site and services lawfully and ethically. You must not infringe the rights of others, disrupt platform functionality, or misuse our content.
3. Purchases and Payments
All WELLSTATE products and services are sold in Australian Dollars (AUD), inclusive of GST (where applicable), and processed via trusted platforms such as Stripe and PayPal.
By purchasing, you confirm that:

Upon successful payment:

You must complete this form honestly and to the best of your knowledge

Optional property visuals (e.g. interior/exterior images, floorplans) may be submitted to support your application
Deliverables include:

A personalised WELLSTATE Wellness Report

An official WELLSTATE Digital Certificate (PDF)

A digital WELLSTATE Certification Badge (Bronze, Silver, or Gold tier)
5. Certification Validity, Misuse & Revocation
WELLSTATE certification is issued based solely on user-submitted information and visuals. It is:

Not government regulated

Not a substitute for legal, medical, or building certification

Proprietary to WELLSTATE and independent of external building codes
WELLSTATE reserves the right to:

Request additional verification or information
-
Revoke, suspend, or deny a certification if false data, manipulation, or misuse is identified

Maintain records of certified properties via serial numbers for verification purposes
Any misuse of the WELLSTATE certification or badge — including reproduction, false display, or resale — will be investigated and may result in legal action.
6. Intellectual Property
All content and materials including (but not limited to):

The WELLSTATE Assessment Framework

The Certification Badge and Certificate designs

Our domain structure, questions, digital assets, and terminology
are the exclusive intellectual property of WELLSTATE GROUP. You may not copy, distribute, modify, reverse-engineer, publish, or use any WELLSTATE tools or assets outside of personal use as part of your certification process.
7. Privacy & Data Collection
WELLSTATE complies with the Privacy Act 1988 (Cth). We collect:

8. Accuracy of Submission & Client Obligations
Clients are responsible for ensuring all data submitted is honest, accurate, and complete. Misrepresentation may result in:

Public invalidation of serial number through our verification system
WELLSTATE may introduce audit procedures for randomised or suspicion-based review of certified properties. Cooperation is expected if requested.
9. User Accounts
For all use accounts:

You are responsible for your login credentials

Misuse, impersonation, or breach of terms may result in suspension or removal
10. Disclaimer
WELLSTATE certification is intended as an advisory, wellness-promoting tool. It does not replace legal, medical, building, or regulatory advice.
WELLSTATE makes no guarantee that a property meets any mandatory legal standard based on its certification outcome.
11. Limitation of Liability
To the extent permitted by law:

WELLSTATE is not liable for any direct, indirect, incidental, or consequential damages resulting from use of the site, certification, or recommendations

If liability must be applied under consumer law, it is limited to resupplying the service or refunding the original purchase amount
12. Refunds and Cancellations
Refunds are only granted under the following conditions:

Technical error or non-receipt of services

Application under Australian Consumer Law
All refund requests must be made within 7 days of purchase and sent to info@wellstate.com.au. Refunds are not guaranteed and are assessed case-by-case.

Each third-party provider operates under its own policies. WELLSTATE is not responsible for their terms or actions.
14. Certificate Verification & Anti-Fraud
Every WELLSTATE Certificate includes a unique serial number. WELLSTATE maintains an internal database of issued certificates and their corresponding property data. Coming soon, users and third parties (e.g. real estate agents) may verify certifications online.
Any certificate found to be falsified or used beyond its scope (e.g. for unauthorised properties) will be subject to investigation.
15. Changes to These Terms
WELLSTATE may revise these Terms & Conditions at any time. Updates will be posted on the website and take effect immediately. Continued use of our services indicates your agreement to the revised terms.
16. Governing Law
These terms are governed by the laws of Victoria, Australia. Any disputes are subject to the non-exclusive jurisdiction of the courts in Victoria.
